Aircraft Charter Contract — Standard Form v1.3

These terms apply to charter services arranged by Crockett Aviation Group Pty Ltd (ABN 48 159 866 538), Hangar 400, Wirraway Drive, Archerfield QLD 4108.

Crockett Aviation arranges aircraft charter services. Charter flights are conducted by an appropriately authorised Air Operator’s Certificate (AOC) holder.

Application

This Agreement constitutes a contract of carriage between Crockett Aviation and the Charterer. The Charterer acknowledges that passengers are carried under the operational control of the Operator. No contractual relationship exists between Crockett Aviation and individual passengers.

The Operator

  • All charter operations are conducted by an authorised AOC holder.
  • The Operator has full operational control of the Aircraft under its AOC.
  • Crockett Aviation acts as contracting party and arranger only.
  • The Operator may substitute the Aircraft with one of equal or greater capability.
  • Any material increase in Charter Price due to substitution must be approved by the Charterer.

Bookings

  • Bookings are confirmed in writing by Crockett Aviation.
  • All bookings are subject to aircraft availability, crew availability and regulatory approval.
  • Bookings are not transferable without written consent.
  • Crockett Aviation may decline or cancel a booking where operational, safety or regulatory requirements cannot be met.

Charter fees and costs

The Charter Price excludes any item not expressly included in the Charter Price or quote, including GST, passenger taxes and security charges, FBO charges, catering, ground handling (including out-of-hours charges), crew accommodation, transport and meals, additional positioning or ferry flights, fuel price variations above the agreed baseline, itinerary changes, and costs arising from delays attributable to the Charterer.

Where practicable, such costs will be notified to the Charterer before being incurred. The Charterer is responsible for any damage to the Aircraft caused by passengers or cargo.

Payment

  • A deposit may be required to confirm the booking.
  • Full payment must be received prior to departure unless otherwise agreed.
  • Crockett Aviation may suspend or cancel the Charter if payment is not received.

Cancellation

Cancellation fees apply as follows:

  • After booking — 20% of the Charter Price
  • Within 72 hours of departure — 50%
  • Within 24 hours of departure — 100%

Travel arrangements and passengers

  • The Charterer must provide passenger details and weights prior to departure.
  • The Charterer is responsible for compliance with all travel, security and customs requirements.
  • The Pilot in Command may refuse carriage of any passenger or cargo.
  • The Charterer is responsible for passenger conduct and compliance with applicable laws.

Dangerous goods

Prohibited or dangerous goods will not be carried. Such goods may be removed or reported to the authorities.

Flight schedule and delays

  • Flight times are estimates only. No guarantee is given as to departure or arrival times.
  • The Operator is not responsible for delays outside its control, and may alter routing or destination for safety or operational reasons.
  • Delays caused by the Charterer or its passengers may result in additional charges.
  • Standby is charged at a minimum of one (1) flight hour per day plus applicable crew costs.

Liability

To the maximum extent permitted by law: operational control and responsibility for the flight rests with the Operator; Crockett Aviation acts as contracting party and arranger only; neither Crockett Aviation nor the Operator is liable for consequential or economic loss; and liability is limited under applicable legislation.

Force majeure

Neither Crockett Aviation nor the Operator is liable for failure to perform due to events beyond their reasonable control, including weather, ATC restrictions, mechanical issues or regulatory action.

Indemnity

The Charterer indemnifies Crockett Aviation and the Operator against breach of this Agreement, passenger misconduct, and carriage of prohibited goods.

Termination

This Agreement may be terminated by agreement or for breach. Immediate termination may occur for safety or regulatory reasons.

Governing law

This Agreement is governed by the laws of Queensland, Australia.

Entire agreement

This Agreement constitutes the entire agreement between the parties.
